Staff Acceptable Use Policy (Part 1)
Staff will employ electronic mail on a daily basis at work as
a primary tool for communications. The district may relay upon this medium
to communicate information, and all staff will be responsible for checking
and reading messages daily.
The network is provided for staff and students to conduct research
and communicate with others. Communications over the network are often
public in nature therefore general rules and standards for professional
behavior and communication will apply.
Network administrators may review files and communications to maintain
system integrity and to ensure that staff members are using system responsibly.
Users should not expect that files stored on district servers will be
private.
The following rules will be strictly enforced:
1. All use of the Internet must be in support of education and research
and consistent with the purposes of the East Side Union High School District.
2. Any use of the network for commercial or for-profit purposes
is prohibited. Use of the network for personal and private business is
prohibited. Any use of the network for product advertisement or political
lobbying is prohibited.
3. Network accounts are to be used only by the authorized owner
of the account for the authorized purpose.
4. Users shall not intentionally seek information on, obtain copies
of, or modify files, other data, or passwords belonging to other users,
or misrepresent other users on the network.
5. All communications and information accessible via the network
should be assumed to be private property.
6. No use of the network shall serve to disrupt the use of the network
by others; hardware or software shall not be destroyed, modified, or abused
in any way.
7. The network is not private. No sharing confidential information
on students or employees.
8. Malicious use of the network to develop programs that harass
other users or infiltrate a computer or computing system and/or damage
the software components of a computer or computing system is prohibited,
as well as, engaging in practices that threaten the network (i.e., loading
files that may introduce a virus).
9. Hate mail, harassment, discriminatory remarks, obscene language
and other antisocial behaviors, are prohibited on the network.
10. The illegal installation and use of copyrighted software on
district computers is prohibited.
11. Use of the network to access or process pornographic material,
inappropriate text files, or files dangerous to the integrity of the local
area network is prohibited.
12. Subscriptions to Listservs must be reported to Information Services
(ext. 75151). Prior approval for Listservs is required for students. Mail
Listservs must be monitored daily and deleted from the personal mail directory
to avoid excessive use of fileserver hard disk space.
13. From time to time, the East Side Union High School District
will make determinations on whether specific uses of the network are consistent
with the acceptable use practice.
I, the undersigned, have read the Staff Acceptable Use Policy and
Legal Issues & Consequences and agree to uphold and follow it. I will
not allow/encourage any student to use the Network without having signed
on to the Acceptable Use Policy. As the sponsoring teacher I do agree to
instruct the student of acceptable use of the network and proper network
etiquette.
The Network Supervisor will report inappropriate behavior to the
employee’s supervisor who will take appropriate disciplinary action. Any
other reports of inappropriate behavior, violations, or complaints will
be routed to the employee’s supervisor for the appropriate action. Violations
may result in a loss of access and/or disciplinary action. When applicable,
law enforcement agencies may be involved.

Casual User Acceptable Use Policy (Part 1)

Legal Issues and Consequences
Acceptable User Policy (Part 2)
The Law: The state of California passed a computer
crime bill in December of 1979. The bill added section 502 to the Penal
code making it a felony to intentionally access any computer system or network
for the purpose of: (1) devising or executing any scheme or artifice to
defraud or extort or (2) obtaining money, property, or services with false
or fraudulent intent, representations, or promises.
It is also a felony to maliciously access, alter, delete, damage
or destroy any computer system, computer network, computer program, or
data. Penalties include fines up to $5000 and/or imprisonment in the state
prison for up to three years or the country jail for up to one year. Anyone
committing acts of this kind will face police charges and disciplinary action
by the school. The person will be punished to the full extent of the law.
Some examples of offenses are removing another users account, changing
other users passwords, using an unauthorized account, damaging any files,
altering the system, or using the system to make money illegally. You cannot
cause damage to any school or District property. This includes the network
system.
Plagiarism: The dictionary defines plagiarism as taking ideas
or writing from another person and offering them as your own. The student
who leads readers to believe that what they are reading is the student’s
original work when it is not is guilty of plagiarism. Credit should always
be given to the person who created the article or the idea.
Be careful when you are using the Internet. Cutting and pasting
ideas into your document is very easy to do. So, be sure that you give
credit to the author. That way your teacher will know which ideas are
yours, and you won’t be guilty of plagiarism.
Copyright: Copyright is another issue altogether. According
to the Copyright Act of 1976, "Fair Use", if you use the Internet or other
information systems, you are allowed to freely use information that is
in the public domain. Copyrighted materials on the Internet can be duplicated
and used by students for scholarly purposes. You may not plagiarize or
sell what you find unless approved by the copyright holder and, must abide
by the fair use areas in the Copyright Act.
Suppose, for example, that you find a copy of Microsoft Works©
on the Internet. Could you legally copy it? The answer is NO. This is
copyrighted software. You have to purchase software packages before you
use them legally. Suppose you find an article about the use of Microsoft
Works© on the Internet. Can you legally copy it? The answer is yes,
as long as you give credit to the author and do not sell the article for
profit.
XIII. East Side Union High School District Board Policy:
The East Side Union High School District declared unethical and
unacceptable behavior just cause for taking disciplinary action, revoking
networking privileges, and/or initiating legal action for any activity
through which an individual:
- Uses the Network for illegal, inappropriate, or
obscene purposes, or in support of such activities. Illegal activities
shall be defined as a violation of local, state, and/or federal laws.
Inappropriate use shall be defined as a violation of the intended use
of the network, and/or purpose and goal. Obscene activities shall be defined
as a violation of generally accepted social standards for use of a publicly-owned
and operated communication vehicle;
- Uses the Network for any illegal activity, including
violation of copyrights or other contracts violating such matters as institutional
or third party copyright, license agreements and other contracts;
- Intentionally disrupts network traffic or crashes
the network and connected systems:
- Degrades or disrupts equipment or system performance;
- Uses the East Side Union High School District
computing resources for commercial or financial gain or fraud;
- Steals data, equipment, or intellectual property;
- Gains unauthorized access of others files, or
vandalizes the data of another user;
- Gains or seeks to gain unauthorized access to
resources or entities;
- Forges electronic mail messages, or uses an account
owned by another user;
- Wastefully uses finite resources;
- Invades the privacy of individuals;
- Posts anonymous messages;
- Possesses any data which might be considered a
violation of these rules in paper, magnetic (disk), or any other form.
Consequences of Violations may include but are not limited
to:
- Suspension of Internet access
- Revocation of Internet access
- Suspension of Network privileges
- Revocation of Network privileges
- Suspension of computer access
- Revocation of computer access
- School suspension
- School expulsion
- Legal action and prosecution by the authorities
Remedies and Resources: If you are accused of any of the
violations, you have all of the rights and privileges that you would
have if you were accused of school vandalism, fighting and so forth.
The District has the right to restrict or terminate Network and
Internet access at any time for any reason. The District further has
the right to monitor Network activity in any form that it seems fit to
maintain the integrity of the Network.

Web Site Policy
PURPOSED
1. Persons developing pages (DEVELOPER) must take credit for
the page and include en Email address link on the page for communication.
If the individual is not an East Side Union High School District employee
(i.e., a student), there must be a sponsoring East Side employee willing
to take on the role of SPONSOR. No student Email address will be allowed
on the East Side WWW pages. The sponsoring staff member may establish an
Email account specifically for the purpose of handling WWW Email (i.e., Lick
Boosters, IHS Band, OG Football Team) and may choose to give students access
to the Email account. Pages may contain a DEVELOPER Email address and a
SPONSOR Email address.
2. No unauthorized person will alter or remove pages created/posted
by other people. Ultimate authority will ride with the East Side District’s
designated East Side Webmaster for the entire East Side WWW site. Under
the East Side Webmaster will be designed Webmasters for schools, departments,
programs, etc. who may wish to establish a presence on the East Side WWW
site. Each school/program without a designated and district recognized WWW
representative will fall under the direct jurisdiction of the East Side Webmaster.
3. All individuals must be trained or demonstrate mastery to be
awarded/granted privileges to add/delete/modify files on any East Side
WWW site. The Information Systems Department will maintain ultimate authority
over the entire site and may delegate that authority as they see fit.
4. Only Webmasters will have the ability/responsibility to add/delete/modify
files in their directory at an East Side WWW site. Each Webmaster is
responsible for any and all files within their area of authority. They
must communicate with other Webmasters if they want their pages linked
to their respective pages. Only Webmasters will post pages and are responsible
for the content and function of those pages before posting.
Webmasters may request accounts and restricted subdirectories within
their site for individuals wishing to maintain their own web pages (i.e.
student pages, teacher pages, clubs, or school related organizations).
These pages must be linked to the site being maintained by the requesting
Webmaster.
5. Individual posting pages and their Webmaster are responsible
for the content of the pages. Pages may be unlinked/removed/modified at
any time by the East Side Webmaster for the following reasons: copyright
violations, violation of school district policy/rules/education code, questionable
links, poor page layout, graphics in excess of 75k, non-working links, poor
spelling/syntax, offensive/derogatory comments, non-educational related
material, negative comments, or any material not considered appropriate
for an educational site and the mission of the East Side Union High School
District. Other reasons as common sense may dictate may not be specifically
delineated above, but can result in the removal of inappropriate Web pages.
6. Do not link pages to a page that says THIS AREA UNDER CONSTRUCTION
for a long period of time. Give information as to when it will be up.
7. All files and programs uploaded to the web sites must be related
to the respective web site. The hard drives are not to be used to store
or archive unlinked files.
8. If there are repeated violations requiring excessive intervention
of the ES Webmaster the violating Webmaster may lose privileges on the
ES WWW site.
9. Webmasters must be ES District employees 18 years of age or over.
No student may be designated a Webmaster. Webmasters are legally responsible
for the pages posted under their authority. In order to become a Webmaster,
the individual must have the sanction/approval/acknowledgment of the highest
authority of the school/program/area they are representing. For example,
school Webmaster must have the approval of the Principal, curriculum Webmaster
must have the approval of the Subject Area Coordinator, etc.
10. No other outside agency/organization/educational institution
may maintain a presence on the ES Web without the knowledge and approval
of the ES Information Systems Department/ES District.

and agree to uphold and follow it. I will not allow/encourage any student
